General Terms and Conditions for the Rental of Real Estate of AE Service AG
1. Contract
The rental contract between the booking guest and Arosa Exklusiv (AE Service AG called landlord) is concluded when the guest has received a detailed reservation confirmation/invoice from the landlord after his contact (online, telephone, email etc.) and has signed and returned as a PDF. The guest must then pay the deposit of 30% of the total amount within 10 days.
With the conclusion of the contract the booked holiday objects are confirmed and the guest accepts the general business conditions shown here.
2. Payment
The price for the whole booked arrangement is due before the arrival and is to be paid as follows:
30% in the following 10 days from the date of reservation confirmation.
The balance of 70% is due 60 days before arrival at the latest. For short term bookings the total amount must be paid immediately.
The payments are to be transferred to the account of the landlord. Please find our account details at the Graubündner Kantonalbank:

Attention: The charges for a foreign bank transfer are at the expense of the ordering party.
Should the transfer not take place within this period, the landlord is authorized to withdraw from the contract.
3. Option on the booked arrangement
The landlord grants the guest an option on the booked rooms for 5 days from the date of the reservation offer. He blocks the accommodation during this period and does not offer it to other guests. If no rental contract is concluded during this period, landlord can dispose of the accommodation again and release it for further rental.
4. Cancellation on the rental contract
If the guest cancels a reservation for any reason, the following cancellation conditions apply.
8 or more weeks before the beginning of the rental period: free of charge
6-8 weeks before the beginning of the rental period: 30% of the rental price
4-6 weeks before the beginning of the rental period: 50% of the rental price
4 or less weeks before the beginning of the rental period: 100% of the rental price
After the conclusion of the contract, the landlord reserves the right to dissolve the contract without compensation within 3 days after its conclusion in case of erroneously communicated contractual conditions (especially concerning the prices or the availability of the service). He shall endeavor to conclude a new contract for an equivalent service. If this is not possible or if the guest rejects the new contract within 5 days after receipt of the notification, the already paid amount will be refunded under exclusion of further claims.
If there is a change of ownership (sale of the holiday property) and the new owner does not want to take over the rental contracts, the landlord shall find a rental property of equal value or reimburse the guest for the amount already paid.
5. Cleaning and responsibility
The tenant is contractually obliged to keep the rental object clean during the rental period. The tenant is liable for any damage to the rental object or inventory. Any damage occurring during the rental period must be reported to the lessor immediately. The costs incurred in the event of damage shall be borne by the tenant. The costs will be charged against the deposit, or the landlord sends a total invoice.
6. Deposit
A deposit of CHF 300 for smaller flats (up to 2.5 rooms) and CHF 500 for larger flats (3.5 rooms or more) is required before arrival. In the event of damage or infringement of point 5 of the GTC's, the expenses incurred will be deducted from this deposit. If the flat has no defects after the stay, the deposit will be returned. For this purpose, the tenant must provide his/her bank account details.
7. Takeover
Complaints concerning the rented property must be made by the tenant at the time of takeover, otherwise it will be assumed that the rented property and its inventory are in good condition as agreed upon and in accordance with the contract.
8. Number of persons
The number of persons indicated on the rental agreement is binding. The tenant undertakes not to sublet the rented property in whole or in part.
9. Additional costs
The following additional costs are included in the calculated final price (total rent): Resort Fee, laundry, final cleaning, electricity and water costs, use of Internet. Additional linen will be charged according to expenditure (CHF 25/package).
10. Pets
Pets are only allowed on request. A one-time fee of CHF 150.00 per pet will be charged separately.
11. Charging station for electric cars
Wallboxes have been installed in several flats. These can be used during your stay on request and with a advance payment of CHF 50. The owner of the charging station reserves the right to claim the costs for the electricity consumption of more than 120 KWh per stay.
12. Smoking
Smoking is strictly forbidden in all objects.
13. Internet
The use of the Internet under false identity, visiting illegal sites or downloading illegal content is prohibited by Swiss law.
14. Valuables
Please make sure that your valuables are insured. The landlord is not liable for any loss or damage to the personal property of the tenant. The tenant is obliged to lock the house when leaving.
15. Applicable law and jurisdiction
Swiss law is exclusively applicable, the exclusive place of jurisdiction for disputes arising from or in connection with the rental agreement is Chur.
Where this contract does not contain special provisions, Articles 253 to 274 of the Swiss Code of Obligations shall apply. The place of jurisdiction for all disputes arising from this contract is the place of the rental property
