1 - PURPOSE OF THE RENTAL AGREEMENT
The parties declare that this lease is not for leased premises for use as a main dwelling or a mixed-use business and a main dwelling.
Consequently, they agree that their respective rights and obligations will be governed by the stipulations of this contract, by the decree of December 28, 1976 amended and failing this by the provisions of the civil code.
The premises covered by this contract are rented furnished on a seasonal basis.
2. DESCRIPTION OF HOUSING

3. DURATION OF SEASONAL RENTAL
The Lessor shall rent to the Lessee the accommodation for the first day of rental from 4 pm (or earlier if possible) on the last day of rental at 10 am, the days of arrival and departure being defined by the tenant at the time of booking.
The Tenant expressly agrees to have fully released the accommodation on the last day of rental at 10 am at the latest, and to return to the Lessor the keys and the access badge to the car park.
At the beginning of the rental, the Landlord will give the Tenant the keys and the instructions relating to the accommodation.
4. RENTAL PRICES AND EXPENSES
The Parties have agreed to set the rent at the amount indicated on the rental schedule for the full term of the lease described in paragraph 2.
The rent above includes, for the duration of the lease, the payment of the rental charges and available supplies recalled hereafter:
- One parking space in the basement and secured
- WIFI
- Television
- Towels
- Air conditioning (living room)
- Pool access (in season: from April to mid-October)
+ 40 euros for final cleaning when you're doing the booking
+ 1.27/ person / day for tourist tax when you're doing the booking
+ Option bedsheets : 5 euros per person that can be added at the booking.
5. BOOKING
The reservation of the accommodation is made by the payment on the site www.vuemercannes.com of deposit of an amount of 30% of the total amount. The payment is done by CB or paypal directemente on the site, through the channel manager www.beds24.com.
6. PRICE RULES
The balance of the rent, will be paid by the Tenant on the day of entry into the accommodation. The Lessee will make this payment in cash or holiday vouchers.
7 - Tourist tax: The tourist taxes are to be added to the rental price (1.27 euros per night per adult).
8. DEPOSIT OF GUARANTEE
Upon entry into the premises, the Lessee shall remit to the Landlord an amount of 200 euros as a security deposit to cover the damage and / or damage to the accommodation and the furniture and objects lining the accommodation caused by the Tenant, as well as as the loss of keys or objects.
The deposit must not be considered by the tenant as a contribution to the payment of rent. It serves in case of damage done by the tenant. If the amount of the losses exceeds the amount of this deposit, the tenant undertakes to settle the damage after the inventory of exit. The owner agrees to justify the amount necessary for the rehabilitation of housing. 9. ASSIGNMENT AND SUB-LEASE
This lease is concluded intuitu personae for the benefit of the only lessee identified at the beginning of the contract.
Any assignment of this lease, any sub-lease total or partial, any provision - even free - are strictly prohibited. The Lessee can not leave the disposal of the premises, even free of charge and / or by loan, to a person outside his home.
10. STATE OF PLACES AND INVENTORIES
An inventory of fixtures and an inventory of the furniture made available to the Tenant are given to the Tenant upon entering the accommodation.
If the inventory and the inventory are not established and signed by the Lessor, or his representative, and the Tenant simultaneously (inventory and contradictory inventories), the inventory of fixtures and inventory made by the Lessor only and delivered to the Tenant upon his entry into the accommodation will be contestable by the Tenant within 48 hours of entering the accommodation. 11. DECLARATION OF THE LESSOR

12. TENANT'S OBLIGATIONS
The Tenant shall make peaceful use of the rented accommodation, furniture and equipment in accordance with the purpose defined in the lease, and shall be liable for any damage or loss that may occur during the contract period in the premises of which they have exclusive enjoyment.
The Tenant shall maintain the rented accommodation and return it in good condition at the end of the contract. If any items listed in the inventory are broken or damaged, the Landlord may claim their replacement value.
The Tenant shall avoid any noise likely to disturb neighbours after 10:30 PM.
Smoking is strictly prohibited inside the accommodation as well as on the terrace. If any smell of tobacco or cigarette traces are detected, a deduction from the security deposit will be automatically applied to cover cleaning and deodorisation costs.
Pets are not permitted in the accommodation.
It is strictly forbidden to organise parties, gatherings or any event likely to disturb the peace of neighbours and the residence.
The Landlord accepts no responsibility for theft or loss of the Tenant's personal belongings. A safe is available in the accommodation for securing valuables.
The Tenant shall respect the maximum number of occupants allowed on the premises, as stated in the property description provided to them.
The Tenant may not refuse access to the premises if the Landlord or their representative requests a visit.
13. CANCELLATION CONDITIONS
Once the booking is confirmed, if the Tenant cancels at least 60 days before their arrival date, they may request a refund of the deposit paid (transaction fees of approximately 2-3% will be deducted). If the cancellation occurs less than 60 days before arrival, the deposit will not be refunded.
Cancellation insurance is available, for example at https://www.albinet.fr/fr/assurance-annulation-sejour, and must be taken out within a maximum of 10 days from the date of booking or signing of this contract. If the Tenant takes out cancellation insurance, it will also cover their civil liability in the event of accidental damage.
15. AUTOMATIC TERMINATION
In the event of a breach by the Tenant of any contractual obligation, this lease shall be automatically terminated. Such termination shall take effect after a period of 48 hours following a formal notice sent by registered letter or hand-delivered letter that has remained unsuccessful.
16. JURISDICTION
For the execution of this agreement, the Landlord and the Tenant elect domicile at their respective addresses. However, in the event of a dispute, only the court of the Landlord's place of residence shall have jurisdiction. This contract and any related matters shall be governed by French law.
